Terms of Use

These terms govern the use of Mandelcloud, including Cockpit, Diary, community features, publishing, remix, account, and paid plans.

The German version is authoritative. English versions are provided for clarity.

These details apply to your use of Mandelcloud. For a purchase through Paddle, the Paddle entity identified at checkout is your seller and Paddle's Buyer Terms also apply to that purchase. Mandelcloud remains responsible for providing the application and product support.

Service and requirements

Mandelcloud provides a browser-based platform for 3D fractal scenes. It includes curated public previews, signed-in browsing, private scene creation in Cockpit, Diary, Collection, publishing, creator profiles, remix, comments, upvotes, follows, local exports, and optional paid plans.

Some features require an account. Users are responsible for keeping credentials secure and must report abusive use without undue delay.

Registration, account use including the Free plan, and purchasing paid subscriptions are limited to people who are at least 18 and have reached the age of majority where they live. Accounts for minors are not offered, including with parental permission. Publicly available previews may be viewed without an account; this does not create a right to an account or paid services.

When registering and making new purchases, you confirm these age requirements. This self-declaration is not identity verification. If we receive specific indications that an account belongs to a minor, we review the case and may proportionately restrict account use. Contact, statutory rights, cancellation, withdrawal, and data protection requests remain available.

Cockpit renders locally through WebGPU and WGSL. It requires a secure HTTPS connection, a current browser that provides WebGPU without experimental switches, hardware acceleration enabled, and a compatible GPU with current system software or graphics drivers. An operating-system, browser, or device name alone does not guarantee compatibility; what matters is whether the browser provides a suitable WebGPU graphics adapter with the capabilities and limits Cockpit needs.

Speed, stability, available output sizes, and appearance depend on the browser, operating system, graphics driver, GPU, memory, device cooling, and scene complexity. Less capable integrated or mobile GPUs may need a lower preview or Safe Mode; demanding scenes and large exports may be slow or exceed the device's limits. Current recommendations and known limitations are published in the FAQ. Users should test the free Cockpit on the intended device before subscribing.

Imported older scenes may need adjustment.

Experimental content, import results, and new creative features may continue to evolve.

Device and browser requirements

Display names, public handles, and identity

You may use a display name or a pseudonym. Display names are not exclusive and may be shared by several users. The public handle (@name) distinguishes your profile and forms part of its address. A handle is assigned to only one account at a time, regardless of letter case. Names and handles do not prove a verified identity or official affiliation.

Available, permitted handles are generally allocated in the order of the first successful handle registration (first come, first served). Statutory claims and third-party rights take precedence over this allocation rule. Allocation does not create ownership of a name or priority over those rights. If you change or release your handle, the previous handle may be allocated again.

Your display name, handle, and other profile information must not infringe third-party name, personality, trademark, or other rights. You must not misleadingly impersonate another person, including a public figure, a company, or the official Mandelcloud team, support, or moderators, or falsely suggest an affiliation. Insulting, threatening, or unlawfully discriminatory profile information is prohibited.

Merely sharing a name does not in itself breach these rules. Fan, parody, or commentary profiles must clearly identify their unofficial nature; a label does not permit other infringements. We assess possible violations in the context of the entire profile and the circumstances of each case.

If a violation is established, we may require a change, remove the affected profile information or handle, or restrict its use, to the extent necessary and proportionate. Where circumstances allow, you will first have an opportunity to respond or correct the information; we may act immediately where prompt action is required. Affected names may be replaced with neutral values and locked against changes pending human review. A handle removed because of a violation may remain reserved against reallocation; release does not automatically restore previous names. A report alone does not result in a handle being transferred to the reporter. Decisions are explained and may be reviewed through the procedure described below.

Own content, publishing, and remix

You retain your rights in your own content, scenes, images, and files, subject to third-party rights.

You may upload or publish only content for which you hold the necessary rights.

Private Diary entries remain private account data unless you intentionally publish them.

By publishing, you grant Mandelcloud a limited, non-exclusive, worldwide license to the extent required to store, process, display, prepare previews of, transmit, back up, moderate, and provide the published content on the platform.

“Image only” publishes the visual presentation without sharing the scene for remixing.

“Image + scene” also shares the scene for remixes in Mandelcloud. Other users may create their own works from it and publish them with a visible credit trail to the source work.

A remix does not transfer rights in the source work and does not overwrite it.

The platform licence generally ends when the content is effectively deleted. Where a published work already forms the basis of third-party remixes, the necessary link may remain anonymised in the Community Vault after deletion or account termination; the licence then survives only for providing, displaying, moderating, and preserving those existing relationships.

Conduct, reports, and moderation

Illegal content, infringement of third-party rights, malware, technical attacks, circumvention of safeguards, spam, and abusive platform use are prohibited.

Public works, profiles, and comments can be reported through the product interface or without a personal account at /report-content. This includes disputed display names and handles, impersonation, and insults. Provide the exact profile or content address, the disputed information, and a specific explanation; when asserting rights, explain your entitlement or authority to act and any available evidence. Normally provide the name of the reporting person or organisation and an email address for the receipt and decision. For notices concerning suspected offences under Articles 3–7 of Directive 2011/93/EU, name and email may be omitted; without email, delivery is not possible. Reports must be accurate and complete to the reporter's knowledge. Legal notices may also be sent to office@mandelcloud.com.

Authorised team members review reports in a timely, careful, and impartial manner. Technical checks of a handle's format and availability are not a legal review; profile-name moderation decisions are not made solely by automated means. We consider the rights and legitimate interests of those involved, including freedom of expression, and choose necessary, proportionate measures.

Authorised members of our team may review reports, document decisions, restrict content visibility, remove reported comments after separate confirmation, and contact affected people.

Affected users can request a review of a moderation decision with the reference ID from the decision notice.

Paid plans and billing

Paid features are offered through recurring subscriptions.

The applicable prices, billing periods, and plan contents are shown on the payment page before completion. Trials apply only if they are explicitly shown there.

The seller, plan, essential service, total price for each billing period, and cancellation terms are displayed before you place an order with an obligation to pay. The purchase and payment are handled through Paddle, as described in the following section.

Mandelcloud applies the small-business VAT scheme under § 19 of the German VAT Act to its own sales. This does not apply to sales by Paddle: Paddle calculates any applicable VAT or sales tax and issues the invoice. The total shown at checkout is authoritative.

Starter and Pro subscriptions are billed monthly. They run for an indefinite term and renew for one month at a time until cancelled. Ordinary cancellation is possible at any time with effect at the end of the current paid billing month; no longer notice period is required.

Price changes for an existing plan apply only to future billing periods and are communicated in text form in good time before taking effect. Where a change is not already permitted by law or the existing contract, consent will be requested; otherwise the subscriber may cancel before the change takes effect.

Before completing a new paid order, immediate access to digital services must be expressly confirmed.

A public withdrawal function is reachable without signing in while a statutory withdrawal right exists for the concrete contract.

Payment details, invoices, and available subscription changes are managed through Paddle.

If there is a payment problem, paid features may pause for new actions until payment is resolved. Existing Diary entries, published works, and stored files are not automatically deleted for that reason.

If an account is over its current storage limit after a plan change, cancellation, or payment failure, new uploads may be blocked. Your own content can still be read, exported, unpublished, or removed unless another reason prevents it.

Cancellation rules are described in the next section.

Statutory consumer rights, including any withdrawal rights, remain unaffected.

Statutory rules for conformity, updates, remedies, price reduction, and termination of digital products and services apply. These Terms do not restrict statutory warranty rights.

Purchases through Paddle, refunds, and cancellation

Starter and Pro subscriptions are offered through Paddle when purchases are available. The following provisions apply to these purchases.

Paddle is the authorised reseller (Merchant of Record) for these purchases. Under Paddle's Buyer Terms, buyers outside the USA and Canada purchase from Paddle.com Market Limited, 30 Old Bailey, London, EC4M 7AU, United Kingdom; the relevant entity is identified at checkout. The purchase is governed by the Paddle Buyer Terms presented there. These Mandelcloud Terms of Use govern use of the application.

Paddle handles payments, invoices, and purchase refunds. For payment questions, refund requests, and cancellation of a Paddle subscription, use the management link in your Paddle confirmation or paddle.net. For product problems and assistance, contact Mandelcloud at support@mandelcloud.com.

Withdrawal and refunds for a Paddle purchase are subject to Paddle's Refund Policy and the mandatory consumer rights in your country. Consumers in the EU or EEA generally have a statutory fourteen-day withdrawal right; statutory conditions and exceptions apply. You can request a refund through paddle.net. A discretionary refund is promised only if expressly offered; statutory rights for defective products remain unaffected.

Cancelling a Paddle subscription stops future renewals and normally takes effect at the end of the current paid period. Cancellation is distinct from withdrawal and a refund. The withdrawal information below for contracts made directly with Mandelcloud does not replace Paddle's information for Paddle purchases.

Plan contents, usage limits, and fair use

Free is the entry plan for local Cockpit creation and the community. It includes high-quality stills, animation playback, and social video in 16:9, 1:1, or 9:16 up to 720p/30 and 12 seconds without sound. One shape and material group can be edited. Free includes no cloud storage, cloud Diary, saved default scene, or publishing of your own works.

Starter adds saved animation views, longer video up to 1080p/30 with sound, and separate transparency images. It also includes cloud Diary, a saved default scene, publishing as an image or remixable scene, profile image and banner, Collection, comments, follows, and Coffee & Caramel. Cloud storage is 2 GiB; preview images for published works are limited to 600 KB per file. One shape and material group can be edited.

Pro adds precise keyframes, curves, expressions, and advanced animation automation, video up to 4K at higher frame rates, image sequences, and separate images for transparency, depth, and surface direction. Up to eight shape and material groups can be edited. Cloud storage is 20 GiB; preview images for published works are limited to 1.25 MB per file. Work details can be up to 1,920 pixels, with an optional high-resolution download up to 4,096 pixels and 8 MB. Sci-Fi is also included.

Only plans and optional services displayed with their content and price immediately before the order, and expressly ordered there, form part of the subscription.

Cloud storage covers uploaded files and space reserved for uploads in progress. New uploads may be blocked when the limit is exhausted or paid features pause because of a payment problem.

Profile images, banners, and preview, detail, and optional high-resolution images for public works count toward the storage limit. Saved scenes, settings, bookmarks, local Diary previews, and local exports do not count toward it.

New publications receive a fast preview up to 640 pixels on the longest edge and a detail image up to 1,280 pixels on Starter or 1,920 pixels on Pro. These limits apply only to community display, not local exports. Smaller source images are not enlarged. The publishing creator's plan determines the limit.

Pro creators may additionally offer a high-resolution PNG, JPEG, WebP, or AVIF image up to 4,096 pixels on the longest edge and 8 MB as an explicit download. It counts toward cloud storage and is not loaded automatically in the stream or work detail.

Community functions such as reading, bookmarks, comments, follows, upvotes, and remixes do not grant a right to unlimited downloads or automated data collection. Automated mass access, large-scale downloads, dataset creation, text and data mining, and model training with platform content are not permitted without express written permission.

For unusually high or abusive use, Mandelcloud may limit access, apply temporary restrictions, or review activity manually. Existing stored content is not automatically deleted for that reason.

Withdrawal information and model withdrawal form

This information applies to paid service contracts you make directly with Mandelcloud. For purchases with Paddle as the seller, see the section on Paddle purchases and the terms linked there.

Right of withdrawal: Consumers have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.

To exercise the right of withdrawal, inform Markus Kösel, Ahornhöhe 22, 87437 Kempten (Allgäu), Germany, email: office@mandelcloud.com, by an unequivocal statement (for example a letter or email) of your decision to withdraw. You may use the model form below, but it is not mandatory. The public online form at /withdraw-contract is also available.

To meet the deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Effects of withdrawal: If you withdraw, we will reimburse all payments received from you without undue delay and no later than fourteen days after the day on which we receive your withdrawal. We will use the same means of payment as for the original transaction unless expressly agreed otherwise; you will not incur fees for the reimbursement.

If you requested that the service begin during the withdrawal period, a reasonable amount prescribed by law may be payable for the service already supplied before withdrawal. For services, the right of withdrawal expires after complete performance only under the statutory conditions, in particular after your prior express consent and acknowledgement that you know of the possible loss of that right.

Withdrawal, cancellation, data export, and account deletion

The following information about processing through Mandelcloud applies to contracts made directly with Mandelcloud. For a Paddle purchase, use the withdrawal, refund, and cancellation routes in the Paddle section. Data export and account deletion are handled by Mandelcloud regardless of the seller.

Withdrawal and cancellation are different declarations. Withdrawal concerns statutory reversal of a withdrawable contract during the withdrawal period. Cancellation ends future renewal of a running subscription.

Withdrawal declarations can be submitted without signing in through the public withdrawal function. The receipt confirmation includes the content, date, and time of receipt.

Signed-in users can manage their subscription under Billing in the account area.

A public cancellation page is also available without signing in. Clear ordinary cancellations for the earliest possible date are scheduled directly; unclear, contradictory, extraordinary, or date-specific requests are reviewed manually.

Cancellation ends future renewal; already paid billing periods are generally not refunded pro rata unless mandatory statutory rights, explicit ordering terms, or individual support decisions require otherwise.

Cancellation, plan changes, or payment failure change future paid features, but do not automatically change ownership of your creations or the visibility of already published works.

Signed-in users can download their account data and creations separately.

Account deletion is request-based and separate from subscription cancellation. Active paid subscriptions must be ended or scheduled for cancellation before final deletion or anonymisation is completed.

Public works that already have remixes may remain anonymised so the origins of those remixes remain understandable.

Availability and liability

Mandelcloud is operated with reasonable care. Uninterrupted availability, specific output times, or identical appearance on every browser and device are not guaranteed.

The operator has unlimited liability for intent, gross negligence, injury to life, body, or health, and under mandatory statutory provisions.

For slight negligence affecting essential contractual duties, liability is limited to typical foreseeable damage. Essential contractual duties are duties whose fulfilment enables proper contract performance and on which users may regularly rely.

Otherwise, liability is excluded to the extent permitted by law. Statutory consumer rights remain unaffected.

Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection rules require otherwise.

If the user is a merchant, legal entity under public law, or special fund under public law, venue is the operator's registered place of business. For consumers, statutory venues apply.

The operator is neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board.

The former EU Online Dispute Resolution platform was discontinued on 20 July 2025; no ODR platform link is provided.

Changes to these terms apply only for the future and will be communicated in an appropriate way where required for existing contractual relationships.
